A mediator can assist you to navigate the dispute and reach an agreement.

Mediation is a voluntary, confidential process where the parties are encouraged by a mediator to understand each other’s perspectives, talk through the issues, identify their mutual interests, develop realistic options, and find a solution that the parties can agree to.

Cost

Before you commit to mediation, we will quote a fixed fee in most circumstances.

 

How mediation works

1. Get in touch

FairWay will guide you through the process of:

  • engaging the other party
  • appointing a mediator.

2. Individual meeting

The mediator will meet with you individually before the mediation to:

  • gain an understanding of your situation
  • answer any questions.

3. Preparation for mediation (optional)

The mediator may also offer and arrange a Preparation For Mediation (PFM) session for you which is designed to help you get the most from the mediated session.

4.  Mediation

This is a confidential and voluntary process where the mediator encourages everyone involved to:

  • develop realistic options
  • reach agreement together.

The joint mediation session usually takes place over a half-day. On reaching an agreement, the mediator will assist you to prepare a written agreement.
